The Service is operated by Wherrelz Corporation, registered in Delaware, United States
Eligibility
- You must be at least 18 years of age to use E99.
- You must provide true and complete contact information in your account and billing details.
- You must agree to our terms, conditions and rules and abide by them.
- You must not use our services for illegal activities or to facilitate an illegal activity.
- You must not use our services to attempt to cause damage / harm / loss / prank E99 or Wherrelz Corp or any of its associates.
- By signing up, you warrant that you meet the above eligibility requirements.
- E99 reserves the right to close or shut down accounts of any users for any reason disclosed or undisclosed and to change these eligibility requirements at any time.
Security, Accounts and Passwords
If you create an online account on E99, you are responsible for maintaining the security of your account and any API key assigned to you. It is up to you as the account owner to keep your password and account name confidential. You are fully
responsible for all activities that occur under the account and API key and any other actions taken in connection with your account or the use of the API by that account or API key. You will contact E99 immediately if you suspect a breach of security
regarding your account.
Payments
Fixed Monthly: Monthly rates offered are base-line rates and credit packs are applicable to your account only if you have a subscription plan.
Buy credit packs: You may purchase any available credit pack at any time. Credits expire with your subscription plan; but can be carried forward as long as you have a valid subscription plan. You can follow your credit changes in your credit
log. E99 reserves the right to change or remove any credit packs or any associated features at any time.
Expiry: If your monthly subscription is discontinued, all the credits in your account expire at that end of the billing period.
Payment: Online payments made on E99 are processed by Stripe ONLY. We do not support receiving payments via PayPal. Stripe does not allow E99 to access your card details.
Payments for any credit packs must be made upfront and they are not refundable.

We understand that you may want to utilize E99 to build smart AI bots and generate corresponding revenue from our programming competitions - however due to maintenance requirements we cannot assure an availability rate over 98%.
General Refund Policy
Any requests for refunds must be in writing by contacting E99 on tanya@e99.one.
Your email must be sent from the email address you have registered with on E99's website.
All requests for refunds must be within 30 days of the last payment date, and you need to have a valid subscription at the time of making the request.
Should E99 change, suspend or remove its website or services, or in case your account is terminated you are not eligible for a refund / payout for credits.
If you fail to comply with any of the rules, conditions, requirements or laws laid out in the Terms Of Use the money back guarantee doesn't apply and you will not be eligible for a refund under any circumstances.
General Payout Policy
Payouts are only enabled for accounts that have fulfilled certain in-game requirements. This may seem tedious but it is an essential step to ensure the quality of our user base.
Payout requests should be made via the in-game Messenger service. A suitable option is provided.
Payout rates can be seen on the wiki here - these are current conversion rates but subject to change based upon demand/supply.
Payout Terms
This section is the ONLY place that completely encapsulates "What you get paid for". Ensure you are completely clear on this, as any payouts from E99 will confirm to these rules alone.
- Compensation is MEANT for your EFFORTS in building the AI program.
- However it's difficult to quantify EFFORTS without extensive tracking systems
- So as a compromise, we use in-game RESOURCES as the nearst 'measurable' compensation method
- Payouts shall be made via Stripe or Paypal only
- If you have multiple accounts, you can request payouts to be clubbed together. Reach out to tanya@e99.one for further guidance on this point
- Minimum permitted payout amount is shown in your dashbard, and changes with the maturity of your account
- E99 will make the final decision on payout - by using this site you agree to this term explicitly and waive your right to arbitration or legal proceedings in the event of a dispute
General Rules
You can sign up for any number of E99 accounts using different email ids. However the payout rules remain independently applicable to each account.
E99's real time API is designed to provide limited access to the platform, and does not replace the need to use the platform itself.
If E99 is under the impression that you have created multiple accounts with malicious intent, we reserve the right to suspend any or all of them.
The failure of E99 to enforce any provision of these terms of use shall not constitute or be construed as a waiver of such provision or of the right to enforce it at a later time.
Disputes
You agree to submit any disputes regarding charges or E99 credits in writing within 30 days of the charge or purchase. You agree that any disputes rendered outside that time period are void and any charges are considered irrefutable. You accept
that refunds are only possible if you comply with and are deemed eligible under the terms stated in the Money Back Guarantee. If your account is terminated or suspended due to any violation of our Terms Of Use or Acceptable Usage Agreement you will
not be entitled to a refund under any circumstances.
Disclaimer of Warranties
The Service is provided "as is" and "as available". Neither E99 / Wherrelz Corp. nor its owners, employees, contractors, suppliers and licensors, make any warranty that this Service will meet your requirements, be error free, accurate, reliable,
compatible, timely or fast enough or that access thereto will be continuous and uninterrupted. You understand that you utilise the service, or otherwise obtain content or services through, this service at your own discretion and risk. E99 does not
warrant that the information on the website, or the information or advice provided by E99's colleagues is complete, accurate, non-misleading or true. E99 has the right to, at E99's sole discretion, change, remove, terminate or recall its Money Back
Guarantee or any other policies with immediate effect.
Limitation of Liability
You agree to accept full responsibility of any loss resulting from the use of E99's website, services, tools, downloads, advices or any other use of the Services. You agree to use the Services and follow advices at your own risk. In no event
will E99 / Wherrelz Corp; nor its owners, employees, contractors, suppliers and licencors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i)
any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; (iii) for interruption of use or loss or corruption of data
Termination
E99 has the right to, at E99's sole discretion (i) refuse to provide service, if in E99's opinion, violates any policy or is in any way harmful or objectionable, or (ii) terminate or deny access to and use of the Service to any individual or
entity for any reason, in E99's sole discretion. Any account which shows no activity for more than 3 months may be considered inactive. If an account is considered inactive, the account may be deactivated. Data for inactive accounts is usually not
deleted but should not be considered perpetually available; any assurances that apply to security or availability of data cease to apply to inactive accounts.
Changes
E99 reserves the right, at its sole discretion, to modify or replace any part of its policies, terms, conditions or rules. It is your responsibility to review E99's terms periodically for changes. Any changes made to E99's Terms of Use, Privacy
Policy or any other policies go into effect immediately and your continued use of or access to the Service following the posting of any changes to this Agreement constitutes acceptance of those changes. E99 reserves the right to change, suspend or
remove (temporarily or permanently) its website or services without notice, and you confirm that E99 and its owners shall not be liable to you for any such change or removal.
Ownership & Intellectual Property Rights
These Terms confer only the right to use the Service while these Terms and the specified licenses are in effect and they do not convey any rights of ownership in or to the Service. All right, title and interest, including without limitation any copyright, patent, trade secret or other intellectual property right in the Service and all content existing or created in or through the Service will remain our sole property. E99 retains all right, title and interest in and to the Service and any content available therein, including, but not limited to, any Games, titles, source and object codes, Game client and server software, other computer codes and software, User Accounts, themes, objects, characters and character likenesses, character names and character profile information, stories, dialogue, catch phrases, locations, artwork, animations, sounds, musical compositions, audio-visual effects, source code, write-ups, concepts and methods of operation, layout, text, data, files, images, graphics, the "look and feel" of the Service, documentation, gaming history and recording of game play, transcripts of any chat rooms or messaging facilities, competitions or other platform activities, and moral rights, whether registered or not, and all applications and derivatives thereof.
YOU ACKNOWLEDGE AND AGREE THAT YOU SHALL HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN THE USER ACCOUNT, AND YOU FURTHER ACKNOWLEDGE AND AGREE THAT ALL RIGHTS IN AND TO THE USER ACCOUNT ARE AND SHALL FOREVER BE OWNED BY AND INURE TO THE BENEFIT OF E99. YOU AGREE THAT YOU HAVE NO RIGHT OR TITLE IN OR TO ANY CONTENT THAT APPEARS IN THE SERVICE, INCLUDING WITHOUT LIMITATION THE VIRTUAL ITEMS (INCLUDING CURRENCY OR RESOURCES) APPEARING OR ORIGINATING IN E99, WHETHER EARNED IN A GAME OR PURCHASED, OR ANY OTHER ATTRIBUTES ASSOCIATED WITH A USER ACCOUNT OR STORED ON THE SERVICE.
Jurisdiction & Binding arbitration; jury trial and class waiver
The Agreement and these Conditions shall be governed by and construed in accordance with the law of Delaware, United States. This Agreement, including the policies included in our other Policies constitutes the entire agreement between E99 /
Wherrelz Corp and which you, the user have agreed to concerning the subject matter herein and pertaining to services as outlined on the website E99.one.
IF YOU ARE A UNITED STATES RESIDENT OR OTHERWISE MAKE ANY CLAIM AGAINST US IN THE UNITED STATES, YOU EXPRESSLY AGREE THAT ANY DISPUTE, CLAIM OR CONTROVERSY BETWEEN YOU AND US ARISING OUT OF OR RELATING TO THE SERVICE, INCLUDING RELATING TO THE APPLICABILITY, ENFORCEABILITY OR VALIDITY OF ANY PROVISION OF THESE TERMS OR THE PRIVACY POLICY (COLLECTIVELY "DISPUTES"), SHALL BE RESOLVED THROUGH CONFIDENTIAL BINDING ARBITRATION CONDUCTED BEFORE AN ARBITRATOR FROM THE AMERICAN ARBITRATION ASSOCIATION ("AAA"), RATHER THAN IN A COURT. THE ARBITRATION WILL BE GOVERNED BY THE AAA'S COMMERCIAL ARBITRATION RULES AND, IF THE ARBITRATOR DEEMS APPLICABLE, THE SUPPLEMENTARY PROCEDURES FOR CONSUMER RELATED DISPUTES (COLLECTIVELY "RULES"), AVAILABLE AT www.adr.org OR BY CALLING 800-778-7879. YOU ACKNOWLEDGE THAT YOU ARE VOLUNTARILY AND KNOWINGLY FORFEITING YOUR RIGHT TO A TRIAL BY JURY AND TO OTHERWISE PROCEED IN A LAWSUIT IN STATE OR FEDERAL COURT. IN THE EVENT OF SUCH A DISPUTE YOU AGREE THAT ANY PAYOUTS, RESOURCES OR CREDIT EARNINGS IN YOUR ACCOUNT WILL BE PUT ON HOLD INDEFINITELY AS PROPERTY OF E99. AS NOTIFIED IN THE "Payout Terms" CLAUSE NOTED ABOVE, CREDITS, RESOURCES OR PAYOUTS DISPUTES SHALL BE RESOLVED BY E99 ONLY.
Payment of arbitration costs will be governed by the AAA's fee schedule, and any arbitration costs due shall be paid by you as the initiator, including any charges that would apply to E99 and/or related entities. We also reserve the right in our sole and exclusive discretion to assume responsibility for all arbitration costs imposed by the AAA. You agree to pay its all attorneys fees and expenses for the duration of the arbitration - including any incidental damages or losses borne by E99 - unless there is a governing statutory provision otherwise.
The arbitration may be conducted in Wilmington, DE in the United States or at Mumbai, MH in India as per E99's sole discretion depending on the context of the claim (technical claims would be addressed by the Technology & Development team based in India and not in the United States). The arbitrator’s award shall be final and binding on you and us and may be entered as a judgment in any court of competent jurisdiction.
As an exception to the binding arbitration rule, to the extent the Dispute arises from (a) a violation of our intellectual property rights; (b) any claim related to, or arising from, allegations of a violation of the safe play, license restrictions, prohibited content or prohibited activities sections of these Terms; or (c) any claim for equitable relief; then both parties agree that a party may seek injunctive remedies (or equivalent urgent legal relief) in any court with jurisdiction over the other party. In addition to the foregoing, in lieu of arbitration, either party may assert an individual action in small claims court for claims that are within the scope of such court's jurisdiction.
To the extent permissible under applicable law, all Disputes shall be resolved by binding confidential arbitration on an individual basis. YOU EXPRESSLY AGREE THAT NO OTHER DISPUTES SHALL BE CONSOLIDATED OR JOINED WITH YOUR DISPUTE, WHETHER THROUGH CLASS ARBITRATION PROCEEDINGS OR OTHERWISE, AND THAT THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE ARBITRATED ON A CLASS-ACTION BASIS, TO UTILIZE CLASS ACTION PROCEDURES, OR TO BE BROUGHT IN A PURPORTED REPRESENTATIVE CAPACITY, AND NO ARBITRATION SHALL BE JOINED WITH ANY OTHER ARBITRATION.
You may opt out of this obligation to arbitrate by choosing to not utilize the E99 platform. You must include your name and residence address and a clear statement that you want to opt out of this arbitration clause. To opt out, you must notify us in writing on tanya@e99.one within thirty (30) days of the date that you first became subject to this arbitration provision.
To begin an arbitration proceeding, you must send a letter to us at tanya@e99.one requesting arbitration and describing your claim. Payout related claims shall be governed by the "Payout Terms" section of this Terms of Use and shall not be subject to aribitration or other legal proceedings whatsoever.
If you are a United States resident, the laws of the State of Delaware, without regard to or application of its conflict of law provisions, will govern these Terms. If you are a resident of a country other than the United States, the laws of India, without regard to or application of its conflict of law provisions, will govern these Terms and any claim, cause of action or dispute arising out of or relating to these Terms will be brought solely in the courts of Mumbai, MH, India. Any Technology & Development related disputes shall remain subject to the laws of India at all times due to the location and base of the development team. You hereby consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum. YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST E99 ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
